Privacy policy: how we handle your data.

Data controller

Pergola A.Ş., with its head office in Ümraniye, Istanbul, is the controller of your personal data. Pergola Inc. is the brand of Pergola A.Ş.

Data we collect

Through the plan and quote form we receive your role, width and depth, series, extras, name, e-mail address, optional phone number, company, country, city, timing, message and consents.

The dealer, architect, catalogue and contact forms collect the same contact fields. In a dealer application you can also share business details such as your showroom status.

When you use Sky Advisor, we store the messages of the chat. However, our logs mask e-mail addresses and phone numbers.

If you choose to contact us on WhatsApp, the conversation runs through WhatsApp and its own terms apply.

As technical data, we process your IP address for rate limiting and abuse prevention. Our hosting provider also keeps server logs.

Why we process data

We use your data to answer your requests, prepare quotes and pass your request to the right team or to the authorised dealer for your region.

We also use it to handle dealer applications, improve the answers of Sky Advisor and keep the website secure. Marketing e-mails only reach you if you have given the separate, optional consent in our forms.

Legal bases

Under KVKK Article 5, we rely on your explicit consent for marketing e-mails and on steps before a contract, such as preparing a quote. For other processing we rely on our legitimate interest or on a legal obligation.

Under the GDPR, we rely on Article 6(1)(a) for consent, Article 6(1)(b) for steps before a contract and Article 6(1)(f) for our legitimate interests.

How long we keep data

We keep request data for up to twenty-four months. After that, we delete or anonymise it, unless a contract requires us to keep it longer.

Recipients and processors

Our hosting provider, Vercel Inc., processes data on our behalf. Once we connect e-mail and CRM providers, they will also process data as our processors.

When Sky Advisor is active, we send your messages to its AI model provider so that it can generate answers. If we route your request to the authorised dealer for your region, that dealer receives your request details.

International transfers

Our hosting and AI providers may process data outside Türkiye and the European Economic Area. In that case, we apply the safeguards that KVKK Article 9 and Chapter V of the GDPR require.

Your rights

Under KVKK Article 11 and GDPR Articles 15 to 22, and to the extent these laws provide, you can ask for access to your data, rectification, erasure and restriction of processing.

You can also ask for data portability, object to processing and withdraw your consent. In addition, you have the right to complain to the Turkish Personal Data Protection Authority (KVKK Kurulu) or to a supervisory authority in the EU.

How to make a request

To use the rights in this privacy policy, e-mail info@pergola.com.tr or write to our head office. Include your name, contact details, your request and proof of identity.

We answer within thirty days under KVKK Article 13 and within one month under GDPR Article 12. Requests cost nothing unless the law allows a fee.

Cookies and browser storage

We do not use advertising or analytics cookies. Browser storage only serves functions such as remembering your role and continuing a Sky Advisor chat, as our cookie policy explains.

Changes

If we add analytics tools later, we will first add a consent banner and then update our cookie policy.
